Open Question: hit someone with a rental truck. No police report, as she was parked illegally. Can she now get money from m?
okay, more detail. I was moving (in Astoria, Queens, NY) and I rented a 16 foot box truck. When i was making a right turn, I swiped a lady who was pulled over making a call. She was illegally pulled over in the middle of the crosswalk and I have pictures to prove it (also, there was a witness who told me he saw several trucks before me turn there and struggle to get by her, and I got his number and name and permission to call if something like this came up). There was a little damage to the back left of her car and no damage to the truck. We went into a local store and made photocopies of each others ID’s and she made a copy of my rental agreement. We called the police, who showed up and said it was our discretion on whether to file a report, and we both declined (as she knew she was parked illegally, and I knew it was my fault). Now a month later her insurance company is calling me asking me for a report to complete their investigation, and the truck company is calling me saying they were contacted by her insurance company about an accident involving the truck in question. What should I do? Ignore everyone? Can the rental company come after me? I never told them I hit anyone, but when I returned it, they looked over it, said it was fine and that was that. I have no insurance of my own as I dont own a car living in NY.
These are helpful but my thought process is that if there is no actual proof of the accident taking place, as there was no police report and when I checked the truck back in with the rental company, they surveyed it and found no damage, and signed off on the return, If I deny it ever took place, what could anyone do about it?
Voting Question: Do you think It would be possible?
to use a pony from my riding centre for shows? The place where I ride is a really nice place and I’ve been riding there for about a year and already they already trust me with the more difficult horses and ponies. The pony I want to show is Millie, a gorgeous bay who is 14.1 hh and would be a huge hit in the show jumping ring. She’s fast and careful too. I would have access to a great instructor and a car and trailer and there’s an arena and lot’s of jumps for practice. I was just wondering if the riding school would actually let me take her to a show or not, because you know, insurance and health & safety.
I’m sure my dad wouldn’t mind paying for show clothes (plus I’m getting a lot of money from relatives at Christmas!) but I was wondering if I would need another hat because the one I have is grey and pink! Would this be allowed in just a few local shows? Or will I need a plain velvet one?
Also could you tell me more about show jumping competitions and what’s allowed and what isn’t? I know about faults and stuff because I have about a dozen of horse books and encyclopedia’s! I have been riding for 7 years by the way! The highest I’ve jumped is 2”9 but I’m sure I could jump a lot higher if I had the chance of doing so.
Kind answers only please! x
Oh, I forgot! Millie belongs to the actual owner of the whole stable yard
Voting Question: Someone has filed an auto insurance claim against me that I believe to be fraudulent.?
On May 23 my husband (the driver) was involved in an incident were my vehicle and the vehicle in front of mine never actually collided and there was no damage. My husband left the “scene” since there was no collision and no damage. He was arrested later that day for leaving the scene of an accident. Since that day the owner/driver and passenger of the other vehicle have filed a bodily injury claim with my insurance company. They have obtained medical records that state they both have spinal injury and their lawyer is seeking a settlement.
When I spoke to my claims adjuster I told him that the driver of the other vehicle was involved in a crash 11 weeks prior to the incident with my vehicle (I was able to obtain his citation records) in which he was driving the same car. He also was cited 6 weeks before my incident for failure to display registration, no proof of insurance, driving vehicle in unsafe equipment, and possession of open container. I told the adjuster that there is no possible way the driver and passenger of the other vehicle could have sustained bodily injury when there is absolutely no damage to my vehicle. And the so called “doctor” that they went to is well known as the “local legal drug dealer” because he is not a credible doctor and he gives high doses of pain medication to people who have no medical need for them. I suggested that they do a complete investigation because these people are committing insurance fraud.
My adjuster told me that they haven’t even filed a claim for property damage to the vehicle; it was only for bodily injury. He said the people in the other car have obtained med records and the insurance company is obligated to use that as evidence whether or not the doctor is credible, and that the insurance co is not allowed to hire a doctor for their own investigation. He agreed that what they are doing is suspicious and what they are doing may be wrong and unjustified but it technically ISN’T fraud… (How is it not fraud???) He said there is little proof to support my side of the story and that they ARE paying the claim & they are going to try to come to a settlement agreement with the lawyer.
WTF???
I don’t have money to obtain my own lawyer but this is complete bull****. I can’t let these people get away with this… they are going to get a minimum of $10,000 for either faking injuries or injuries sustained in a prior accident. Does anyone have suggestions or guidance for me?????
The incident was an almost-accident… he avoided collision. The driver of the other car wrote down my tag number and the responding officer obtained my insurance info from my registered tag. The claims adjuster told me that my limit is $10,000 so that’s what they will offer for the settlement.
