Resolved Question: I got in traffic accident, I was rear ended, other vehicle had no insurance. What do I do?
I got rear ended about a month ago, I was in a complete stop on a red light and an unissued truck ran into me while they were eating a cheeseburger!

No visible cosmetic damage on rear bumper but, its a Honda Accord and they just pop out as soon as they are bumped. There might be structure damage but… probably just minimal if any.

Called the police, and he got really mad and cussed a few times. I didn’t listen to him. Just waited for the police to come, He failed to provide insurance and was sited for not doing so and also got sited for the accident.

This guy started freaking out and got really mad when I called the police. He started saying the “F” word a few times.

I got the police report from the police department. He had no insurance!! What a surprise.

My neck started hurting more and more as days went by (greatest pain around day 5), I had a few meetings where I had to look to my side for 20-60 minutes and it was brutal! I had troubles looking to the sides of my car before turning because of the pain. Can site and look at the computer without having my neck to hurt.

I don’t have health insurance but do have a discount for some health centers. So I vised my doctor 4 days after, said that it most likely not serious and it should just fade away withing 1-3 weeks. Recommended that I take over the counter medicine. Also Said if pain is too great after a week should reschedule another appointment and get x rays. payed a copay of 15.00 and drove back home (1hr drive to see my doc)

Now, after a month my necks gets a dual pain in the bottom of my neck. This happens most when I sit in my computer to do homework. I never had this problem before. I am a college student and sitting in front of a computer is not something you can avoid.

Key things:
Got rear ended – I was never at fault
Other person FAILED to show insurance
My neck hurts (from 0-10 it hurts around 2-3)
I don’t have health insurance – had from parents but they lost work
I don’t have uninsured coverage in my insurance policy.
I am a college student – don’t know much about this stuff

What should I do?

I ask because people have been telling me to file a law suite! But I just don’t have a clue
The person was going around 10mph when he hit my car. not dramatic but enough to cause damage to a person’s neck.

I live in Colorado

Resolved Question: What would you do…?
My car insurance runs out at midday tomorrow (yes i know i’ve left it a bit late!) my renewal said £195, money supermarket gave the cheapest quote as the same company for £171, I called the company at 11am who checked and the policies were identical but they had to get a team leader to authorise the discount but they’ll call me back by 8pm tonight. I will be calling again shortly but assuming I don’t get an answer what would you do in this scenario

I leave my car half way to work on a (reasonably wide) street within a business park, have for a long time and no accidents (If I got the bus it would cost me £7.20, a walk in the cold and at least 30mins longer on journeys)

a) safe option – leave your car at home
b) take your car and call the company in the morning and if need be pay the larger amount to ensure you have insurance (perhaps complain at a later date)
c) take your car and call the company and kick up a real fuss and only pay the lesser amount even if it means being without insurance for a few hours
d) A N Other

Resolved Question: Dealt with car accident outside of insurance company, how can I chase up the receipt?
On Christmas Day I went out in the car to pick up some drinks from the petrol station and on the way out of the station I bumped someones car. I stopped and got out to give them my details (name, address and phone number) and then went home. In the panic of the moment I think I just wanted to get home as it was Christmas Day and I didn’t hang around to take photos, ask for witnesses or discuss options with the other driver, which in hindsight I regret and realise was stupid.

When I got home, the guy called me up and, again with the stupid mistakes, I said that I would rather settle outside of insurance; the driver wasn’t keen on the idea at first and wanted to settle through the insurance company but I couldn’t call them until the next week as they were closed for Christmas.

He texted me the next day saying that he was going to get a quote from a garage and got back to me later with a quote for £400 through a ‘friend of a friend’s garage’. At this point I was a bit suspicious and the amount seemed very high for what I thought was not a lot of damage but at the same time he said that he either wanted to do it like that or through the insurance and I really didn’t want to loose my no-claims discount as insurance for young male drivers is very high without the no-claims. In the end I decided to pay him, not without a certain bitterness owing to the fact that he was pressuring me for an immediate decision, which also made me suspicious.

Having sent the cheque for £400, he kept up communications initially and let me know that he’d received it. He said that he would send me a copy of the receipt from the garage for my records but once he received the cheque I never heard back and now cannot get a reply.

Bit long-winded for a question but that’s the background story, my question is two-fold:

1. Can I do anything about it? It’s more the principle than the money that bothers me, I know that I caused damage to his car but I now suspect it wasn’t as much as he claimed.

2. Does £400 sound like too much or should I stop worrying about it? I hit the back corner of his car with the back corner of mine, and he later told me that I had cracked the rear bumper, which needed replacing. I’m not sure of the make of the car but I think it may have been a Ford Fiesta or something similar.

I would really appreciate any help as it’s weighing on my mind… I don’t like people walking over me. At least if the amount he claimed sounds reasonable I can put it down to him being a wanker but the amount claimed being fair and forget about the whole thing.
