Open Question: Advise on a settlement package please?
Two drivers, no witnesses. One jumps a red light, rams into the vehicle having the green light and totals it. Green light driver is able to prove they looked out, and attempted to avoid through skid marks. Red light jumper has no skid marks which proves they did not slow down, attempt to avoid a collision or yield.

Green light driver did, besides having green light, slow down, looked both ways, and attempted to avoid the collision.

Red light driver’s insurance has agreed to pay for all damages that red light driver caused, EXCEPT green light driver’s car (which had only liability on it.) Red light driver refuses to talk to adjuster who is representative of insurance company insuring Green Light driver’s car.

Red light driver totaled green light driver’s vehicle, his own vehicle and ran into a building damaging it. Impact damage to Green light driver’s vehicle proves that Red Light Driver hit him.

Police responded but did not issue citations.

How does Green light driver go about demanding Red light driver’s insurers to pay for the value of his totaled car?

If Red light’s insurance company has agreed to pay for damages that red light driver caused, it should also be responsible for paying for value of green light driver’s car, correct?

My point exactly. If Red light’s driver is paying for damages that red light driver cause, it should also be responsible for paying for value of green light driver’s car, correct?

Resolved Question: What does Collision really cover?
I have a 2001 Rav4L. KBB estimates a $9000 value. I’m insured with Liberty Mutual. It went from about $1500 to $1200/year when I took off collision. I can get a $700/year elsewhere with the same specifications.

My question is, what does collision really cover? Examples:
- If I get in an accident and it’s not my fault does the other driver’s insurance pay for my repairs?
- If I get in an accident and it’s my fault, that means my insurance won’t pay for it, right?
- If someone sideswaps me while I’m parked or “hits and runs”, I am not covered for repairs?
- If I hit a mailbox or pole, my repairs aren’t covered either?
- If my car is totaled and I’m at fault (or not), I get no money for it?

I plan on using the car less and park it so I’m trying to determine the probabilities and the risks associated with them. What would you do if you had a car with 65K miles in good condition valued at $9,000? I doubt the insurance company will give me $8,000 for it even if I have a $1000 deductible on my collision.
